A local upstate New York judge has resigned over allegations he sent sexist and threatening texts about his ex-girlfriend.
The resignation of Owasco Town Court Judge Mark DiVietro was announced this week by the state Commission on Judicial Conduct. A message was left Saturday with the town court clerk.
Commission papers alleged that in 2018 DiVietro “repeatedly sent text messages to his then-girlfriend that contained threats about a former girlfriend.” Many were “vulgar, crude, demeaning and/or featured extreme gender-based slurs and profanity,” the papers said.
DiVietro was also accused of sending secret communications in 2020 giving advice about how a defendant in a felony case could avoid getting his firearms confiscated.
The commission dropped the disciplinary case after DiVietro quit and signed a stipulation agreeing not seek any judicial office going forward.
