FORT WORTH, Texas (AP) - A Tarrant County grand jury has declined to indict a deputy constable sergeant in the fatal shooting of a man who drew a gun as he was being served with an arrest warrant for failing to pay child support.

The Tarrant County district attorney’s office said the constable was no-billed Monday in the fatal shooting of 42-year-old Scott Holland in August 2013 at a Fort Worth apartment complex.

The constable was assisting the Texas Attorney General’s Office in serving a warrant.



The district attorney’s office says when the constable informed Holland that he was under arrest, Holland removed a gun from his waistband and pointed it the constable, who then fatally shot Holland.

The district attorney’s office says all critical police incidents are taken to the grand jury.
