A federal judge in northern Mississippi ruled on Tuesday, Nov. 27, 2018, that Choctaw County and Sheriff Cloyd Halford liable for jailing Jauch for 96 days without seeing a judge in 2012. The judge is setting a trial in 2019 to determine damages, but the county and Halford are appealing to the U.S. Supreme Court, seeking to get the case thrown out. She wasn’t cleared until she finally got a lawyer who persuaded a prosecutor to watch the video and drop the charge. When Jauch sued, alleging violations of her rights, a federal judge dismissed her case against the county and a sheriff, ruling none of her constitutional and legal rights were violated. The outcome has flummoxed civil liberties advocates who have been waging legal battles to reform Mississippi’s criminal justice system, which provides almost no state funding for public defenders.
