Baltimore police said a man who was being held on a murder charge but was released was taken back into custody this weekend in North Carolina after authorities explained that Maryland officials failed to file for the suspect’s extradition in time.
Baltimore police said Charles Anthony Boatwright, 56, was re-arrested Saturday in Charlotte following his release from jail on Wednesday.
Mr. Boatwright is accused of fatally shooting 56-year-old Randolph Smith on July 13 in the 3900 block of Frederick Avenue in Baltimore.
The Mecklenburg County Sheriff’s Office said its deputies nabbed Mr. Boatwright on July 16 and charged him with being a fugitive from Maryland.
But the sheriff’s office said repeated attempts to receive a governor’s warrant — which is required to begin the extradition process — were not answered by Baltimore police brass.
By law, Charlotte officials were forced to release Mr. Boatwright after a 90-day holding period.
The circumstances of Mr. Boatwright’s second arrest in the Charlotte area were not made clear.
The Washington Times has reached out to Baltimore police to find out if they have submitted a governor’s warrant for the suspect.
