OPINION:
Supreme Court Justice Amy Coney Barrett rebuked Justice Ketanji Brown Jackson’s dissent in Trump v. Casa, noting: “We observe only this: Justice Jackson decries an imperial Executive while embracing an imperial Judiciary.”
What did she mean by an imperial judiciary? Likely exactly what’s shown in “Rogue judge Indira Talwani issues authoritarian ruling in Planned Parenthood case” (Web, July 14). Couple Judge Talwani’s arrogant and unlawful order with the many orders imposing universal injunctions right after the Supreme Court order limiting the power of lower courts to issue nationwide injunctions — and you see the absolute, unchecked power of the federal judiciary (the “imperial Judiciary”) on full display.
Sen. Mike Lee’s steps to initiate impeachment proceedings against Judge Talwani should be allowed to proceed. The federal judiciary must be held accountable for its unlawful orders and the limits of its authority must be clearly established.
It’s obvious that rogue judges will not abide by Supreme Court decisions, so the people, through their elected representatives, must hold these rogue justices accountable. Failing to do so makes the three branches of government and the separation of powers irrelevant and mocks our constitutional federal republic.
Congress must act now and impeach judge Talwani.
