The antisemites over at the International Criminal Court continue their legal backflips to assert jurisdiction over the Gaza war (“ICC prosecutor seeks arrest warrant for Israeli and Hamas leaders, including Netanyahu,” web, May 20).

Attempting to justify jurisdiction, the International Criminal Court makes the contradictory argument on its own website, conceding that “the ICC is not constitutionally competent to determine matters of statehood” and it had not “adjudicated a border dispute under international law.” However, it has decided that Palestine is a “State party to the ICC Rome Statute” anyway.

Furthermore, the court is accusing Israel of atrocities as an occupying force when the court defines “occupied” as being under “effective control of hostile foreign armed forces.” In reality, Israel is fighting a declared war against Hamas, the Islamic terrorists that make up the elected government of Gaza, and Israel’s military is experiencing continued and significant resistance to its efforts to defeat Hamas.



With Hamas utilizing between 350 and 450 miles of tunnels to fight against Israel, the argument that Israel has “effective control” is disingenuous at best.
