OPINION:
“The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”
These are the words of the Ninth Amendment to the Constitution. The Framers were leaving a door open for more fundamental rights, which would be discovered as the centuries passed. They knew it was impossible to anticipate any new such rights until an issue requiring one arose.
Well, that time is now and the issue is millions of foreign nationals illegally crossing our borders with little or no effort by the federal government to stop them. Specifically, the issue is the violent criminals, human traffickers, drugs and drug traffickers, diseases and terrorists among the majority of good people crossing the border. It is also the states and local communities that have declared themselves sanctuaries and have said they will no longer assist federal agents seeking such individuals.
I am asking the U.S. district courts, courts of appeal and the Supreme Court to rule that the people have a fundamental right to a federal government that properly secures our borders. This includes strong walls and sufficient numbers of U.S. Border Patrol agents, Immigration and Customs Enforcement agents, and immigration judges.
Employees of federal, state and local governments, up to and including the president, governors and mayors or the equivalent, should prepare to be sued personally for failing to do their respective duties.
