CARSON CITY, Nev. (AP) - Carson City District Attorney Jason Woodbury has filed a petition seeking a coroner’s inquest into the stabbing death of a man who served prison time for his role in a high-profile killing at a Carson City motel in 1998.

Woodbury filed the request in Carson Justice Court this week regarding the February stabbing death of Clinton Malone.

Malone was stabbed several times by the resident of a Carson City home who told deputies he found Malone inside his home that night and stabbed him in the altercation that followed, sheriff’s deputies said. The resident’s name has not been released.



Malone was one of 10 American Indian youths who were charged in the beating death of Sammy Resendiz. Prosecutors identified them as members of rival gangs.

Rocky Boice was convicted of second-degree murder in 2002. Malone and six others received a five-year sentence after pleading guilty to battery with a deadly weapon.

Woodbury said there’s been a lot of confusion about exactly what happened the February night of Malone’s stabbing. He said a coroner’s jury will be asked to review all evidence in the case and decide whether it was justifiable homicide or a murder.
