When it comes to the 2020 presidential election, it’s not about the votes counted. It’s about the process in which the votes were counted.

In 2000’s Bush v. Gore case, the Supreme Court sided with George W. Bush. The justices detemined the vote was unconstitutional on grounds that there were no clear standards applied to all ballots. In the 2020 election some in-person voters had to show IDs with signatures, and there were time constraints. Mail-in voters had no such restrictions imposed.

Bush v. Gore held that standard-less recounts violate the 14th Amendment’s Equal Protection clause. This ruling should apply to Trump v. Biden.
