ATLANTA (AP) - Police say a Georgia woman ignored a 911 dispatcher’s instructions not to follow a hit-and-run driver before she confronted and fatally shot him.
WSB-TV reports that Clayton County Det. Keon Hayward testified on Tuesday that Hannah Payne blocked the driver, Kenneth Herring, and said, “’Get out of the car.’” The news station said a judge later ruled that the case against the 21-year-old Payne could move forward.
Police have said Payne witnessed Herring get into a crash with another car and then try to leave the scene. Payne’s attorney, Matt Tucker, has said Payne shot Herring in self-defense after he bruised her and ripped her shirt. The 62-year-old was shot in the stomach.
Prosecutors say Payne was the aggressor.
