FORT SMITH, Ark. (AP) - A prosecutor says he will not file charges “at this time” in connection with the death of an inmate at the Sebastian County jail in Fort Smith.

Sheriff’s deputies found 64-year-old Douglas Jay Gunter on the floor of his cell March 9 with an injury to his head. Gunter died the following day at a hospital.

Prosecuting Attorney Daniel Shue said in a letter to state police released Monday that Gunter may have injured his head by falling and that an autopsy found he suffered a complication from pneumonia in addition to a fractured rib.



Gunter was arrested last October for aggravated assault and Shue said the rib injury may have occurred before his arrest.

The cause of death is listed as undetermined and Shue noted the cause could be amended if more information is developed as to how the rib injury occurred.
