DIANA, N.Y. (AP) - New York state police say the driver of an all-terrain vehicle is dead after she swerved to avoid a truck and her vehicle overturned.

It happened just before 1 p.m. Friday in the town of Diana in upstate Lewis County.

Police say 53-year-old Tammy Shears was driving a Suzuki ATV when she rounded a curve and drove into the path of a Dodge pickup driven by 20-year-old Isaiah Young.

State police say Shears swerved, which caused the ATV to overturn.

Shears and a passenger, 28-year-old Bailey Dougherty, were both ejected. Shears was pronounced dead at the scene. Dougherty was hospitalized with severe leg injuries. Young was not injured.

The accident is under investigation.
