WILLIAMSON, W.Va. (AP) - A judge has dismissed a driving under the influence charge against a West Virginia school bus driver accused of being impaired while driving students to a soccer game.
WSAZ-TV reports a criminal judgment filed on Monday in Boone County magistrate court shows a judge dismissed the charge against David Lee Justice Jr.
A prosecutor told WSAZ the defense attorney requested that charges be dropped because blood work isn’t back in the case. The motion was granted, but prosecutors can refile the charge if they get new evidence within a year of the alleged offense.
A criminal complaint says an officer spotted the bus weaving across the center line of a highway last August and pulled it over. It says Justice failed several field sobriety tests and was arrested. He has maintained his innocence.
