PRINCETON, W.Va. (AP) - A mistrial was declared in the trial of a West Virginia man charged in a fatal accident on Interstate 77 after a member of the jury became ill.

News outlets report a Mercer County judge declared the mistrial Friday in the case of Nicholas C. Andrepont. As the jury began deliberations, two alternate jurors were dismissed. But upon returning from a lunch break, the judge was told one juror became ill and could not return.

The judge said the trial would be rescheduled for October.



Andrepont was charged with driving in an impaired state causing death after a September 2017 crash near Camp Creek that killed 27-year-old Cody Tyler Kincaid of Beckley. Their vehicle was going the wrong way when it struck a tractor-trailer head on.

The defense argued Kincaid was the driver.
