BOZEMAN, Mont. (AP) - A developer is suing a Montana county after officials denied its plans to build condos near the Gallatin River.
Gallatin County Commissioners denied the proposal for 18 condos by Eco-Camp in August.
Officials said they were concerned about the condos’ proximity to the river.
The Bozeman Daily Chronicle reports that the lawsuit filed in district court Thursday asks that the decision be overruled.
According to the suit, county standards allow construction beyond 300 feet from the river’s high water mark.
But the developer and county officials disagreed about where that mark falls. Commissioners did not feel the developer’s mitigation plan was sufficient and denied the project.
Eco-Camp’s attorney says the developer was willing to move the buildings further back from the river but commissioners did not give that opportunity.
