OPINION:
We now see that due process and the rule of law for the accused is nowhere to be seen when leftist politicians are joined by a leftist media to broadcast unsubstantiated rumors and statements to the nation. They know full well that the court of public opinion they have set out to influence can be mightier than a real court of law.
But that doesn’t mean the law shouldn’t be used here. Justice Clarence Thomas’ sole accuser had no other evidence. Judge Brett Kavanaugh’s accusers have no other evidence. And let’s not even start on the “back-alley abortions” Judge Robert Bork would supposedly be instituting if he were confirmed. With a clean FBI vetting concluded and no other evidence even being proffered for last-minute, uncorroborated claims, Sen. Chuck Grassley should be calling for a vote now on Judge Kavanaugh’s nomination. Meanwhile, the judge’s clerks should research defamation per se, with malice, against a public figure.
A civil suit for money damages only requires a preponderance (51 percent) of the evidence. Sure, the League of Bewildered Socialists or some such organization will defend the female accuser, but if the judge wins, it can be a payday for him or his charities, a warning to leftist smear merchants and a lesson to today’s women that perceived sexual affronts while teen-agers three and four decades ago (and never reported or uttered since) require evidence today in a nation of law and order.
Sue, Judge Kavanaugh, and when your accusers provide zip for evidence in a court of law and you collect their money, you can hopefully reverse this tabloid tide so that future innocent judicial nominees and their families will no longer have to endure such unjustified indignity.
