MOSES LAKE, Wash. (AP) - A judge has found two brothers not guilty in connection with a July 2017 shooting in Moses Lake that left a woman with a gunshot wound to the head.
The Columbia Basin Herald reports Judge John Antosz found 22-year-old Jesus Torres and 20-year-old Jonathan Torres not guilty of assault and drive-by shooting charges following a bench trial.
The state argued Jesus Torres fired a weapon at a vehicle with three occupants following a scuffle at a cannabis store. Prosecutors claimed Jonathan Torres was driving the vehicle his brother was firing from.
In his ruling, Antosz says the biggest issues surrounding the case involved the identity of the driver and the shooter in the vehicle.
Antosz says there was no evidence offered by the state to prove beyond a reasonable doubt that Jesus was the shooter or that Jonathan was the driver.
