DOVER, Del. (AP) - A 14-year-old boy who has a long history of criminal behavior and has been declared incompetent to stand trial will be subject to Family Court jurisdiction, a move Delaware prosecutors say could endanger public safety.
A Superior Court judge on Friday transferred charges against the Wilmington boy to Family Court, where he already has 15 other matters pending. He was charged after a shooting last year with assault, possession of a firearm by a prohibited juvenile, and other crimes.
The boy has been declared incompetent to stand trial in Superior Court because of several anger-related diagnoses.
But prosecutors note that Family Court rules regarding incompetent defendants require charges to be dismissed after a certain time, and fear that the boy will likely wind up shooting someone or being shot himself.
