LA VISTA, Neb. (AP) - The driver of a loaded concrete truck that tipped onto a car near Omaha, killing two people, is no longer facing felony charges in the case.
Omaha television station KETV reports that a judge said Thursday that there’s not enough evidence to prosecute 20-year-old Austin Holloway, of Fremont. Holloway had been charged with two felony counts of motor vehicle homicide for the Oct. 25 crash that killed Michael Dearden and Phillip Hertel, who were both 23.
Sarpy County Judge Todd Hutton said Thursday the case will remain open. But he says there’s no evidence that Holloway was speeding or driving recklessly at the time of the crash.
Investigators say Holloway was driving the loaded concrete truck in La Vista he made a sharp right turn, causing it to tip and land on a Dearden’s car stopped at a traffic light. Hertel was a passenger in the car.
