MONTPELIER, Vt. (AP) - The Vermont Supreme Court has struck down the first lawsuit challenging the state’s authority under Vermont’s school merger law.
Judges concluded Washington resident H. Brooke Paige lacked standing to challenge the constitutionality of Vermont’s school district consolidation law. The Times Argus reports Paige had appealed the lawsuit after it was dismissed earlier this year for other reasons.
The court affirmed the dismissal and also found a lower court had erred by granting Paige standing in the first place.
Paige’s lawsuit had named the state, then-Education Secretary Rebecca Holcombe, the state Board of Education and the Washington School Board as defendants.
