MONTGOMERY, Ala. (AP) - The Alabama Supreme Court says the estate of a driver who died in a crash with a Selma fire truck can move ahead with a wrongful death lawsuit against the city.
The justices cleared the way Friday for a lawsuit by representatives of the late Aubrey Vick, who was killed in a wreck on Sept. 19, 2008.
The court’s opinion says Vick was driving a pickup truck that collided with a city fire truck in an intersection.
The city asked a lower court to dismiss the complaint by saying that government officials are immune from lawsuits when performing their jobs.
Justices refused, ruling that the fire truck wasn’t on a firefighting mission at the time and noting that firefighters had stopped at a grocery store before the wreck.
