ENGLEWOOD, Ohio (AP) - A grand jury has declined to indict an Ohio police officer who fatally shot an armed man while searching for a suspected shooter at a motel.
Montgomery County’s prosecutor said Friday that the grand jury determined the actions of the officer who shot 41-year-old Shelly Porter III in February were legal under the circumstances.
Police in Englewood in southwestern Ohio responded to a call about a man who allegedly shot a firearm from a motel room rented by Porter. Officers found ammunition in the room, but didn’t find the suspect or a firearm.
The Englewood officer found Porter in the parking lot of another motel. Authorities say Porter refused to comply with the officer’s commands, a fight ensued and the officer fired after Porter pointed his gun at the officer.
