NORTHAMPTON, Mass. (AP) - Police in Massachusetts will not charge the driver involved in a crash that killed a 78-year-old cyclist.

The Daily Hampshire Gazette reports (https://bit.ly/2rtJVbh ) Wednesday that police confirmed 39-year-old Maicky Rivera, of Holyoke, will not be charged.

Police say Rivera’s SUV struck Alan Porter at an intersection in Northampton May 15. Porter was taken to Baystate Medical Center where he later died.



Police say Rivera was travelling 6 mph above the 30 mph speed limit. However, investigators say other factors contributed to the severity of the crash.

The Northampton man was not wearing a helmet at the time of the crash. Investigators say his head hit the windshield of the SUV.

Rivera says his line of sight was obstructed by plants and that he didn’t see Porter before trying to stop.
