HARRISBURG, Pa. (AP) - The Pennsylvania Supreme Court has ruled that a school district must reinstate a teacher fired for drug possession.
The Tribune reports (https://bit.ly/2jAIe4T ) Joseph Melnick was fired by the New Kensington-Arnold School District in 2014 after he was sentenced to two years probation without verdict for two misdemeanor marijuana charges. A state arbitrator ruled that the school district did not properly fire Melnick and also owed him back pay in 2015.
New Kensington-Arnold appealed the decision and was denied by a Westmoreland County judge in 2015. The district was denied a second time after appealing to the state Commonwealth Court. The Supreme Court denied their third appeal on Monday.
According to Raymond Sekula, the district labor attorney, the district will appeal again. New Kensington-Arnold has two weeks to submit their petition.
