BILOXI, Miss. (AP) - A wrongful death lawsuit has been filed against a Mississippi city on behalf of the son of a man who was impaled during a Mardi Gras parade.
News outlets report that the mother of 20-year-old Braydon Hester’s youngest son filed a lawsuit against the city of Biloxi on Nov. 13, accusing the city of negligence.
Hester fell from the back of a parked pickup truck onto a spike of rebar, which is reinforced steel, while watching the Gulf Coast Carnival Association parade on Feb. 28. The lawsuit says the city violated Occupational Safety and Health Administration regulations and failed to assess the risk the rebar posed.
Toxicology tests showed Hester had no drugs or alcohol in his system at the time.
The city has not yet responded to the lawsuit.
