PROVIDENCE, R.I. (AP) - A Rhode Island firefighter accused of soliciting a minor for nude photos and sending indecent material to a minor has agreed to drop an unlawful suspension lawsuit against the city of Providence.

Jason August’s lawsuit claimed the city and Public Safety Commissioner Steven Pare violated the firefighters’ union’s collective bargaining agreement and his constitutional rights.

WPRI-TV reports (https://bit.ly/2vafurZ ) that according to the settlement agreement signed last month, August will be allowed to apply for his pension when he turns 55 without being challenged by the city. The Providence Retirement Board could still take its own action.

August will receive almost $26,300 for his unused sick and vacation time.

Pare says “the pension was a tough pill to swallow.”

August has pleaded not guilty in the pending criminal case.
