BYRON, N.Y. (AP) - State police say a 60-year-old western New York man who was struck and killed by a freight train may have been photographing deer along the tracks.

Troopers say David Swinton of Byron was near the tracks in his Genesee County hometown around 10:30 a.m. Sunday when he was hit by a passing CSX train.

Police say Swinton was an avid hunter and apparently was photographing deer in a rural area near the tracks.



Troopers believe the train’s operator wasn’t at fault and was operating within the regulations.

The accident remains under investigation.
