PHILIPPI, W.Va. (AP) - A former Davis & Elkins baseball player has been sentenced to two years’ probation for his no contest plea to a misdemeanor hazing charge.
Twenty-one-year-old Marcus Alan Warner of Tully, New York, was sentenced this week in Barbour County Circuit Court.
The Exponent Telegram (https://bit.ly/1KGiAlz) reports the hazing incident of a Davis & Elkins teammate occurred after a 2013 scrimmage in Philippi.
As part of a plea agreement between Warner’s attorney and Barbour County Prosecutor Leckta Poling, a charge of second-degree sexual assault was dismissed.
Among other things, a judge also ordered Warner to pay more than $3,000 restitution for the victim’s counseling fees.
Warner is no longer listed on Davis & Elkins’ roster.
