LITTLE ROCK, Ark. (AP) - Arkansas Attorney General Dustin McDaniel is asking a judge to suspend his ruling striking down the state’s gay marriage ban while it’s appealed.
McDaniel on Friday evening asked Pulaski County Circuit Judge Chris Piazza’s to issue an immediate stay of his decision that Arkansas’ same-sex marriage ban is unconstitutional. A spokesman said McDaniel is seeking the stay because questions about the “validity” of any actions taken because of the ruling could arise.
McDaniel is appealing Piazza’s ruling to the state Supreme Court.
Piazza’s ruling comes nearly a week after McDaniel announced he supports gay marriage, but would continue defending the state’s ban in court. McDaniel, a Democrat serving his final year in office, is the first statewide elected official to support same-sex marriage.
