CHARLESTON, W.Va. (AP) - The West Virginia Supreme Court says a circuit judge erred when he dropped several sexual abuse charges against a Fayette County school bus driver.
The case against Steven R. Malay Sr. will proceed after prosecutors asked justices to reverse a lower court’s order that dropped six of eight counts against Malay.
According to court filings, Malay is accused of sexually abusing a 14-year-old female student who rode on his bus. The alleged abuse occurred at the girl’s home while her parents were sleeping and at Malay’s farm.
The Charleston Gazette reports (https://bit.ly/1gPG6TS) that a Fayette County judge last year dismissed six of the counts because he ruled the juvenile wasn’t under Malay’s care when the alleged abuse happened.
The Supreme Court ruled that decision should be left to a jury.
