SEATTLE (AP) - The 68-year-old woman who was in the SUV that plowed through a waterfront home, killing family members inside, and crashed into Lake Sammamish smelled of alcohol when an investigator first questioned her.

King County authorities say a toxicology report is pending for the May 16 crash.

The initial report filed by investigators after the May 16 crash stated the woman’s breath strongly smelled of “alcohol intoxicants.” The report also says the woman declined a voluntary sobriety test, instead opting to contact an attorney.

Authorities say the woman was in a Jeep SUV with her 2-year-old grandson on her lap when the vehicle crashed through the house last Friday, killing her 70-year-old husband, injuring her son-in-law and her 34-year-old daughter. The son-in-law died Monday. The daughter remains hospitalized and the grandson was not injured.

The woman is being investigated for vehicular homicide, but has not been charged.
