ALBION, Ind. (AP) - An unprecedented battle over where two Fort Wayne men should be tried in the death of a woman in 2011 could delay the case for a year and might not result in murder charges.

Thirty-two-year-old Victor Gonzalez and 35-year-old Andres Gonzalez are charged in the death of Erin Justin. Her body was pulled from a Noble County lake in July 2011.

Investigators said she had drugs in her system and a concrete block tied to her body to weigh it down.



But The Journal Gazette (https://bit.ly/1fUYL0j ) reports investigators still aren’t sure whether her death was an accident or intentional or where she died.

Noble County prosecutors want to keep the case and are appealing a judge’s order sending the case back to Allen County, where the crime reportedly occurred.
