COLUMBUS, Ohio (AP) - A central Ohio man suspected of accidentally killing his 4-year-old son is seeking release on bond during a federal case alleging he never applied for permanent U.S. residence and used fake identification.
An immigration investigator’s affidavit says Natividad (nah-tihv-ee-DAHD’) de Jesus Hernandez is from El Salvador and was using a permanent resident card with someone else’s registration number.
Authorities say Hernandez accidentally ran over his son with his van in Union County on Dec. 26. Hernandez has pleaded not guilty in state court to charges including aggravated vehicular homicide and forgery.
Defense attorney Arthur Mullins requested Monday that a federal detention order against Hernandez be revoked based on a recent suggestion by federal prosecutors that the immigration charges, which mirror some state charges, could be dropped.
