CHARLESTON, W.Va. (AP) - A former Kanawha County Junior ROTC instructor convicted of having a sexual relationship with a student will serve 52 weekends in jail.

Forty-four-year-old Martin Dale Kirby also will spend five years on supervised probation and must register as a sex offender.

Media outlets report that Kirby was sentenced Wednesday in Kanawha County Circuit Court. He had entered a Kennedy plea to sexual abuse by a person of trust in January. Under the Kennedy rule, a defendant doesn’t admit guilt.



Kirby was hired as a Junior ROTC instructor at George Washington High School in 2010. Prosecutors say he had a sexual relationship with a 17-year-old female student in September 2010.
