FORT WORTH, Texas (AP) - A grand jury has decided to file no criminal charges against a Fort Worth police officer involved in the fatal shooting of an armed homeowner.

The Tarrant County grand jury declined an indictment against Officer R.A. Hoeppner in the May 2013 shooting of 72-year-old Jerry Waller.

Hoeppner was one of two officers who went to an east Fort Worth home on a burglary call before dawn May 28. But they went to the wrong house, encountered Waller and shot him dead when he refused to drop his handgun.



The other officer involved in the incident, Officer Benjamin B. Hanlon, was fired in October for falsifying an arrest affidavit in an unrelated traffic stop.
