GILLETTE, Wyo. (AP) - A judge has dismissed an aggravated vehicular homicide charge against a 33-year-old South Dakota man who ran over and killed another man with a dump truck at a Gillette construction site.
The Gillette News Record reports (https://bit.ly/1dYelpK ) Circuit Judge Wendy M. Bartlett dismissed the charge against Andrew Michael Ames on Thursday. The Yankton, S.D., man was charged after the truck he was driving ran over 38-year-old Jason Thompson on Aug. 5.
Ames told investigators he had been drinking the night before, but Bartlett said there was insufficient evidence that his intoxication level while driving caused Thompson’s death. She also said there wasn’t enough evidence to establish that Ames drove recklessly.
Ames faced up to 20 years in prison if convicted.
