PORTLAND, Ore. (AP) - The 9th U.S. Circuit Court of Appeals has affirmed the conviction of a 45-year-old Portland man who tried to entice a 16-year-old girl to have sex with him.

Randy Lee Shill claimed the 10-year prison sentence he received is cruel and unusual punishment.

He also said Congress couldn’t have intended for its federal online enticement statute to apply when the sex act itself - had it occurred - might be a misdemeanor under Oregon law.



Shill was arrested in November 2010, a month after meeting the girl at a high school football game and sending her a Facebook friend request.

The girl’s parents told police, and an FBI agent assumed the girl’s identity for online chats.

Shill arranged to meet for sex and arrived with condoms, flowers, alcohol and Viagra.
