PIERRE, S.D. (AP) - A Pierre judge has denied requests to dismiss the case against a Pierre teen accused of killing a classmate and remove the prosecutor.
KCCR-AM reports Judge John Brown did grant a defense motion Thursday to keep some evidence out of the case against 17-year-old Braiden McCahren.
The teen pleaded not guilty to first-degree murder in the December 2012 shooting death of 16-year-old Dalton Williams.
Prosecutors say McCahren deliberately pointed a loaded gun at a third juvenile and fired but hit Williams instead. The defense says the shooting was an accident.
Brown will take more argument next month on whether McCahren should be tried as a juvenile or adult.
McCahren was not at Thursday’s hearing. He is out on bond and under house arrest at his grandparents’ home in Vermillion.
