BILLINGS, Mont. (AP) - A man who was arrested in Montana for violating his parole in a California case has waived extradition, but not before hitting his public defender.

The Billings Gazette reports (https://bit.ly/1aJPH9x ) 32-year-old David Anthony Aguilar appeared in Justice Court Tuesday by video from the Yellowstone County jail when he raised his handcuffed hands and hit public defender Erik Moore on the side of the head, causing a small cut.

The Gazette reports officers could be seen rushing to restrain Aguilar.



Moore left and a second public defender took over. Aguilar waived extradition, clearing the way for law enforcement officers from California to pick him up. It was not clear why he was wanted in California.

The Yellowstone County attorney’s office said Wednesday that no additional charges were immediately filed against Aguilar.
