YOUNGSTOWN, Ohio (AP) - The former senior official of a northeast Ohio wastewater company charged with violating the federal Clean Water Act goes on trial April 8.
The Youngstown Vindicator reports (https://bit.ly/1jmFYve ) 62-year-old Ben Lupo, of Poland, and Hardrock Excavating LLC have a final pre-trial conference scheduled with U.S. District Judge Donald C. Nugent on March 24.
Authorities allege Lupo ordered an employee to repeatedly dump gas-drilling wastewater intended for an injection well into a storm sewer. Lupo and the company have pleaded not guilty.
The employee, 34-year-old Michael P. Guesman, of Cortland, entered a guilty plea in August. His written plea agreement states Lupo asked him to dump brine and drilling mud from 20,000-gallon storage tanks down a storm drain on 24 nights beginning Dec. 12, 2012.
Guesman will be sentenced March 20.
