NEWARK, N.J. (AP) - A New Jersey appeals court says one parent can’t sue the other for negligent supervision when their child does wrong.
The appeals panel upheld a lower court judge who dismissed the case in Essex County.
John Paleski had told his ex-wife, Jonna Cali, that he did not want their two sons in his home while he went to South America in 2009. The couple share joint custody.
Paleski said his 17-year-old son defied his mother and had a party in the home. Paleski said he discovered jewelry valued at over $38,000 and $200 in cash were missing.
Paleski said Cali had a duty to supervise their son and was negligent in failing to prevent him from entering the home.
The appeals court says no such law or policy exists.
