LYNCHBURG, Va. (AP) - Lynchburg prosecutors say a Liberty University security guard won’t face criminal charges in the fatal shooting of a student.
The Lynchburg Commonwealth’s Attorney Office says in a report that A.S. Mulberry was acting in self-defense when he shot 19-year-old Joshua Hathaway.
The report says Hathaway pulled out a mallet from under his shirt and attacked the guard with it. The attack occurred after Hathaway approached Mulberry at a residential annex and told the guard he had been mugged and his car had been stolen.
The prosecutors’ report says Mulberry’s belief that he was in danger of death or serious harm was reasonable.
The incident occurred on Nov. 19, 2013.
