ANDERSON, S.C. (AP) - A judge in Anderson has delayed a decision on whether to reduce the prison sentence for a Greenville attorney convicted in a fraud case.
Lawyers for Fredrick Scott Pfeiffer asked Circuit Judge Cordell Maddox to reconsider their client’s sentence because of the sentence a co-defendant in the Capital Investment Funding case received, The Greenville News (https://grnol.co/1mHbG8y) reported.
“All I’m asking the court is to look at it, try to think about what is a fair way to equitably treat Mr. Pfeiffer at this point,” his attorney, William Yarborough, told Maddox.
Pfeiffer, 48, was sentenced to six years in prison after pleading guilty to two counts of securities fraud and one count of conspiracy.
The former manager of the Easley company, Arthur Field, was released eight days after he was sentenced to about two years in prison. Government prosecutors are asking that Field’s sentence be reconsidered.
Prosecutors said Tuesday Pfeiffer did not deserve a shorter sentence, saying he acted on his own and was not misled by Field..
Field had pleaded guilty to 11 counts of securities fraud, two counts of conspiracy and one of forgery.
Maddox said he would schedule a new hearing to consider both requests.
A judge approved a mediated settlement agreement in which Capital Investment Funding, which sold promissory notes to investors, acknowledged a judgment of nearly $38.5 million to 688 investors.
