LAS CRUCES, N.M. (AP) - Authorities say a man was shot and wounded by Las Cruces police after pulling out a handgun that turned out to be an air pistol.

Police say the BB gun closely resembles a 9mm handgun used by law enforcement agencies.

The name of the 42-year-old man hasn’t been released.

He was taken to a hospital for treatment of a non-life threatening gunshot wound to an upper arm and police say no charges have been filed against him at this time.

Police responded to the scene of a possible domestic dispute between a man and a woman near a food mart Tuesday night and were told that one of the persons was armed.

Officers say the man pulled out what looked like a handgun and refused commands to drop it.
