FARGO, N.D. (AP) - A judge has ordered a mental evaluation for a North Dakota woman accused of killing her husband by means of drugs and asphyxiation.

Sixty-one-year-old Sherry Midstokke, of Finley, is charged with Class AA felony murder in the death of 66-year-old Lyle Midstokke. She remains jailed on $500,000 bond.

KFGO radio reports that the judge’s order came out of a status hearing held Wednesday in Fargo.



Midstokke told a judge on Feb. 5 that she believed bail was too steep. She argued that she is not a flight risk or danger to the community.

Prosecutor Charlie Stock said earlier that a mental evaluation is meant to protect Midstokke as well as the general public.

Midstokke’s lawyer, Blake Haney, was out of the office and not available for comment.
