MAYFIELD, N.Y. (AP) - State police say an upstate New York man is dead after being hit by a vehicle after helping his brother replace a tire on a woman’s disabled car.
Troopers say 64-year-old Charles Van Every was standing with 37-year-old Darcy Lawton on a road in Mayfield, their hometown, when both were hit just before 9:30 a.m. Thursday.
They say Van Every died at the scene. Lawton was hospitalized with leg injuries that aren’t life-threatening.
Van Every’s brother, garage owner Pearl Van Every, wasn’t injured.
Troopers say Friday that no charges have been filed so far against the driver, 84-year-old Robert Haner of Northville. They also say there’s no indication drugs or alcohol played a role in the accident.
The investigation is continuing.
