AUSTIN, Texas (AP) - Prosecutors are using Brandon Daniel’s words against him as his capital murder trial in the killing of an Austin police officer enters its third day.

A police video screened for a Travis County jury shows the 26-year-old former software engineer asking what punishment he might get for the April 2012 death of Austin police Officer Jaime Padron (HYE’-may pah-DROHN’).

The video shows Daniel in the back seat of a police car, asking an officer, “Can I get the lethal injection? Is it possible?” Receiving no response, Daniel says, “I’ll probably go away the rest of my life.”



As the car heads to police headquarters, Daniel says, “I am glad he is dead. I will see you in hell.”

Prosecutors want the jury to send Daniel to death row.
