DALLAS (AP) - A Dallas County grand jury has decided not to indict a state district judge on a felony charge of assault following a domestic disturbance with his girlfriend.
Jurors made the decision Thursday in a case involving Judge Carlos Cortez.
He was arrested Dec. 28 on allegations he choked the 26-year-old woman, leaned her over the edge of the balcony at his apartment and threatened to kill her.
In a motion filed two days later, the 44-year-old Cortez said the woman was trying to kill herself and he tried to pull her away from the balcony.
Cortez asked a judge to throw out an emergency protective order granted after the incident.
Cortez had been charged with family violence assault, a third-degree felony punishable by up to 10 years in prison.
