FARGO, N.D. (AP) - The North Dakota Supreme Court has denied an appeal by a man convicted of murdering another man in Fargo in 1991.

Reginald Tweed is serving a life sentence for killing 32-year-old Terry Dorff, who was hit five times in the head with a 17-pound rock.

Authorities say Tweed and a friend, David Sumner, who both lived in Moorhead, Minn., at the time, had gone to Dorff’s apartment after the three men met at an adult bookstore in Fargo. Tweed told authorities he began to hit Dorff after Dorff made sexual advances.

Sumner was charged with murder but acquitted. Tweed refused to testify against Sumner.

The Supreme Court on Friday ruled that Tweed cannot prove that his lawyer was ineffective in arguing an appeal for a new trial.
