MILTON, Del. (AP) - One Sussex County town is considering easing restrictions on where sex offenders can live.
The Daily Times reports (https://delmarvane.ws/1csiVqS ) that Milton’s sex offender residency restrictions bar sex offenders from living within 3,000 feet of a school, park or child care center, but that covers the entire 1.2-square mile town.
Town Solicitor Seth Thompson says attorneys for two potential violators intend to challenge the rules if they aren’t changed. So, the town is considering lowering the 3,000-foot radius so that sex offenders could legally live in Milton.
Thompson says officials want to make sure the town can withstand a constitutional challenge. He says the city’s policy differs from state code by dealing with all sex offenders, not just high-risk offenders. State law also uses a 500-foot radius.
